Fight On! Rhode Heads For En Banc

The Ninth Circuit yesterday granted en banc review in the case of Rhode v. Bonta, setting aside for the moment the ruling of the three-judge panel back in July that declared California’s ammunition background check scheme unconstitutional.

Such an outcome is par for the course when the Ninth Circuit considers Second Amendment cases. CRPA President & General Counsel Chuck Michel stopped in for a chat with CRPA TV host Kevin Small to break down what comes next in a battle that has raged on over seven years now.

No historical analogs exist for such a restrictive and faulty background check and our brief opposing en banc review pointed out why:

“(CA’s background check)…regime imposes a much more substantial burden on Second Amendment rights than licensing regimes and background checks to acquire firearms—which likely explains why ammunition background checks were nonexistent for nearly the first two-and-a-half centuries of our Nation.”

Time and again the state defends its gun control agenda as promoting public safety, but nothing could be further from the truth. They want your guns (and your family members’ and your friends’ and so on…). That’s the agenda, PURE AND SIMPLE!
