Still Waiting? What’s Next at SCOTUS?

Is this another case of “no news is good news”? Is time running out? After listing several 2A cases for last Friday’s Supreme Court conference, yesterday’s order list for the Court did NOT include any of those cases.
The temptation to lose hope grows, but attorney Anna Barvir, who has worked extensively on Duncan v. Bonta, says there is still reason for optimism. In the latest installment of CRPA TV, Ann stops by to dive into the burning 2A questions at SCOTUS, including:
- Having already decided to hear cases about “who” can exercise their 2A rights and “where” those rights can be exercised, doesn’t the Court have to also take on a case about “what” an arm is to begin with?
- Could the Court provide broader guidance on application through Wolford or Hemani? If so, what would that mean?
- What if the Court “grants, vacates, and remands” (GVR) the case back to the Ninth Circuit yet again? And what would the implications be for those who own standard capacity magazines?

Given that the Court has already taken two Second Amendment cases, this already shapes up to be a historic year. By this summer, we’ll have decisions in those cases and at least some changes to the legal landscape for 2A cases.
