DC Decision A Boost For Duncan
As the Supreme Court rolls through a potentially historic session, one big (and pretty fundamental) question remains outstanding: “What is an arm?”
The case of Duncan v. Bonta, CRPA’s challenge to California’s standard capacity magazine ban, and a couple other cases pending before the Court could serve as a means of answering that question. Thus far, however, none have been granted certiorari to be heard.
A recent decision from the DC Court of Appeals provides a push in the right direction. As CRPA President & General Counsel Chuck Michel explains in the latest installment of CRPA TV, the decision in Benson v. United States, overturning DC’s magazine ban, creates a very clear circuit split that increases the likelihood of the Court taking the case.

As Chuck points out, the DC court also impressively applied the precedents in Heller and Bruen, something we’ve seen all too little of in the past couple years. Wins in court, even the Supreme Court, are only as good as the faulty application of those decisions. We need to end that once and for all!
