More Magazine Ban Madness

As we await some sort of disposition from the Supreme Court on Duncan v. Bonta, the stakes got a little higher on magazine bans.

Last week, the federal Department of Justice announced it was suing Colorado over the state’s ban on magazines of 15 rounds or more. This follows a decision in Benson v. United States that already created a clear circuit split on the issue of magazine bans.

And that is just one element of the existential question “what is an arm?” for purposes of applying the Second Amendment. Having already taken cases that address “where” the Second Amendment applies and to “who”, this final question is crucial.

What difference does it make to have rights that can simply be skirted by jurisdictions that play word games?
