CA DOJ Proposed Regulations: AB 1263 Notice Requirements Now Subject to Dealer Inspections
The California DOJ has proposed amendments to existing regulations regarding California’s “Firearm Industry Standard of Conduct” that would make AB 1263 notice-and-acknowledgment records an inspectable item during routine dealer inspections.
Key Proposed Requirements
1. Produce records on demand. During a DOJ inspection, dealers must make available the completed “Notice and Acknowledgment Regarding Firearms Manufacturing Crimes” (BOF 146 or similar document) for every qualifying transaction involving a firearm accessory, firearm manufacturing machine, or unattached firearm barrel.
2. Purchaser must print and sign. Each notice must bear the prospective purchaser’s printed name and signature confirming they received and understood it.
3. Transaction-specific details required. Each notice must include the date of sale or delivery and the dealer’s name and license number.
4. Three-year retention. Dealers must provide a copy to the purchaser and retain the original for three years. Electronic format is permitted.
Why This Matters
AB 1263 (effective January 1, 2026) already requires these notices as a condition of sale, with civil liability for noncompliance. The proposed regulations add a second enforcement layer: DOJ inspectors will now verify compliance during dealer inspections. Under the DOJ’s separate proposed civil fines framework, inspection violations can carry fines of $100 to $3,000 per violation and potential license forfeiture.
