HUGE NEWS! SCOTUS Takes Up “What Is An Arm?”

After victorious rulings in Hemani and Wolford, the good news kept on coming today as the Supreme Court closed its current term by granting cert in the (now consolidated) cases of Viramontes v. Cook County and Grant v. Higgins. Both cases center on firearm bans and should provide a clear and actionable ruling on the question of what qualifies as an “arm” for purposes of Second Amendment protection.

CRPA’s own Duncan v. Bonta remains pending with the Court and it seems quite reasonable to forecast that a decisive ruling in Viramontes/Grant would send Duncan back to the Ninth Circuit with a vacated ruling and an opportunity to overturn California’s assault weapon ban.
