Rhode Recap: Chuck Michel Joins CRPA TV With Practical Advice

It’s been one wild week in the fight against California’s onerous regulations on the sale of ammunition.  First, a historic, soundly reasoned injunction that astutely applied Bruen and other key 2A decisions.  Then, just a few days later, a two sentence stay of that ruling.

There’s an old saying in the legal profession that goes:
“When the law is on your side, argue the law. When the facts are  on your side, argue the facts.  And when you have neither on your side, kick over the table.”  So what does it tell you about the state’s case when even the Ninth Circuit has nothing to say in defense of putting these blatantly unconstitutional regulations back in place?

As Judge Benitez’ ruling in Rhode v. Bonta shows, the merits of our arguments clearly meet the standards set by Bruen and its predecessor decisions.  The idea that the Second Amendment doesn’t apply to ammunition is ludicrous on its face.  So now, the case moves forward to its next hearing.
