AB 574 Creating Chaos For Gun Retailers

The philosophical principle known as “Hanlon’s Razor” reminds us that we should “never put down to malice that which is easily explained by incompetence.” As Governor Newsom, AG Bonta, and their allies in the legislature breathlessly pursue their gun control agenda, it can be hard for lawful gun owners to tell the difference.
AB 574 embodies this conundrum. Signed into law back in 2023, the new law took effect this month, adding a question to the Dealer Record of Sale (DROS) seeking to verify that the buyer has, in the past 30 days, “checked and confirmed possession” of any firearms they already own. Confusion abounds about what impact this question might have, as checking “no” could, conceivably, bar the individual from purchasing the new firearm despite the fact that there is no law on the books that would justify such a prohibition. Unsurprisingly, Bonta’s Department of Justice has not supplied guidance that could clear any of this up.
