Will Congress Help With The Suppressor Ban?

We’ve talked a good bit lately about California’s ban on suppressors and by now you are aware that CRPA’s Sanchez v. Bonta case seeks to repeal that ban. A new bill pending in Congress, H.R. 404, could bolster that effort and yesterday’s debate over a Republican-led budget proposal put the issue in the spotlight.

A proposal to eliminate the $200 tax on suppressors made its way to the 400-page budget proposal and drew heated debate. H.R. 404, should it pass, would eliminate the tax as well as the registration requirement by removing suppressors from the National Firearms Act (NFA).

This is yet another example of how the Ninth Circuit has, in Chuck’s words, “bastardized” the standard put in place with by Bruen decision. And the Ninth Circuit is not alone, as courts in Illinois, New York and other jurisdictions decide for themselves what is and is not an “arm” and skirt right around Bruen and the Second Amendment.
