New from CRPA TV: Recapping Today’s Wolford Decision

It’s been an exciting week for the 2A community, first with the announcement of U.S. v. Hemani last week, followed by today’s momentous ruling in Wolford v. Lopez.

With a clear and resounding majority opinion this morning, the Supreme Court ruled Hawaii’s “sensitive places” law unconstitutional. The ruling rejects Hawaii’s attempt to use property rights law to invalidate Second Amendment rights and disposed neatly of the government’s “historical analogues”, which included so-called Black Laws. The majority opinion specifically called out the use of laws to disarm black Americans as an argument that “cannot be taken seriously.”

In today’s installment of CRPA TV, host Kevin Small takes us through today’s ruling and what it might mean when the case returns to the Ninth Circuit, and is subsequently applied to May v. Bonta, CRPA’s challenge to California’s SB 2 “sensitive places” law.

Hemani and Wolford provide reason for optimism going forward as CRPA and our allies continue to challenge California’s overly restrictive gun laws. A decision on the cert petition for Duncan v. Bonta could also be a game-changer, as dozens of cases across the country await the Supreme Court’s guidance on what qualifies as an “arm” for purposes of Second Amendment protections.
