IMPORTANT! New Guidance on “1 in 30” Law
On Friday, August 19, we previously issued guidance on processing transactions following the Ninth Circuit’s decision in Nguyen v. Bonta enjoining California Penal Code sections 27535 and 27540(f). Shortly after publishing our guidance on how to process transactions in the DROS Entry System (“DES”), the California Department of Justice (“DOJ”) issued a bulletin and further guidance in DES. DOJ’s guidance states it has modified DES allowing users to place multiple firearms in the pending cart and submit them to DOJ in the same transaction. Furthermore, dealers need not select any option in the “30-day restriction exemption” drop down field in DES.
As a result of this guidance, we are advising dealers and members of the public to disregard our prior guidance which is now out-of-date following the recent changes made by DOJ.
