No tax means no need for a registry, so are the registration requirements of the National Firearms Act still constitutional? That’s the question posed by a “big, beautiful lawsuit” recently filed by Gun Owners of America.
By now, you’ve likely heard or read that the OBBBA, the spending bill recently passed by Congress and signed into law by the President, eliminated the tax on suppressors and certain firearms. With no tax to collect, GOA claims there’s no basis and, just as important under Bruen, no historical analogue for a law that requires one to register an item just to exercise a fundamental right.
