The State Responds on Duncan (Kinda)!
Well, we all knew the state would reply to CRPA’s push to get the Supreme Court to review Duncan v. Bonta as the next landmark 2A case. But, frankly, their response is weaker than one might expect.
In the latest installment of CRPA TV, CRPA President Chuck Michel checks in to provide insight into the highly procedural arguments (to be kind) made by the State of California in their recent brief (you can read it all here if you have the stomach for it). Chuck also looks ahead to what may come next as the the Court reviews its pending cert petitions.
Whether or not they have much of a leg to stand on, the state MUST respond to try to keep Duncan off the SCOTUS docket. They know what we know: that the Bruen standard needs clarification and Duncan provides the perfect vehicle to accomplish that vital goal.
